It’s important as you jump into the civil litigation process that you understand how insurance companies work. You need to understand that each insurance company is like a person. They have their own personality. Some are easier to get along with. Some are horrible to get along with. You need an experienced trial lawyer, personal injury lawyer who understands the personalities of each of these companies. The insurance companies can only pay claims if in fact the file is worked up, if in fact there’s enough paper in the file to justify them paying a claim. You need to understand that claims adjusters get audited just like anybody else. They have to be able to defend their decisions. So how do we do that? We do that by putting together a packet of materials involving medical bills, lost wages, how this has affected you from a general damage standpoint, how it’s affected your everyday life. That takes weeks and months to prepare, but at the end we will present them a packet to each of these insurance companies and they will want to settle your claim rather than want to fight you over your claim.
