The third element of a personal injury claim is damages. After you’ve established negligence and established that that negligence did in fact cause you some harm of some kind, then we get into damages. Damages are primarily what are called economic damages and non-economic damages. Economic damages are lost wages, medical bills, future lost wages, future medical bills, out-of-pocket hard cash. We will gather all of that information and that’s part of the packets that we will send to an insurance company eventually. The second phase of damages are what are called general damages. General damages, pain and suffering, loss of enjoyment of life, loss of a loved one, all more esoteric type of damages that juries have to think about and claim adjusters have to evaluate; but again, we have to win on negligence, we have to win on causation, and we have to establish our damages.
