It’s important for you to understand the elements of a personal injury case or a medical malpractice case. They are the same elements. It’s where I spend my life. It’s where personal injury lawyers and firms spend most of their time. The elements are negligence, causation, and damages. The important thing you need to know from your own personal standpoint is we as your lawyer and as our team, we have to win on all three. The defense, the insurance company, only has to win on one. We have to prove that somebody was negligent, that negligence caused you injury, either through an auto accident or medical malpractice, and that you have damages that arise out of that. We have all three to prove.
