One of the main areas of my practice is within the context of medical malpractice. I’ve been handling medical malpractice cases for almost 30 years. What is a medical malpractice case? Medical malpractice case is a case filed by an individual who has been harmed by some type of healthcare provider whether it be a nurse, a physician, a clinic, a hospital. It has a relatively short statute of limitations. To preserve the claim it has to be filed relatively early. Medical malpractice cases are difficult, they are expensive and should only be handled by people who know what they’re doing. Basically the elements of a medical malpractice case are negligence, causation, and damages. We have to cover the same basic elements. We just have to have expert opinions, retain experts usually from out of state to come in and point fingers and explain what went wrong, what happened, and why there was medical negligence or medical mistakes made. Since I’m not a physician it is important for me to have a nurse paralegal review the medical records. We get all the medical records and then we send it out to other healthcare providers whether it be a neurologist or an orthopedic surgeon or a nurse expert whoever who will then help us determine whether you do have a case. Medical malpractice cases usually take weeks if not months to determine if we have a case. It takes a great amount of work and effort just to develop the case, but that’s what I’ve been doing for 28 years and that’s what I’ll do for you if you come in and hire me to handle your case.
